Terms of Use (ToU) – Hinatou.fr

Article 1 – Preamble

These Terms of Use (“ToU”) govern the relationship between the publisher of Hinatou.fr and any person accessing its services. Hinatou.fr is operated by Hinatou (Hina Prod), a sole proprietorship based in France. Use of the website implies full acceptance of these Terms, which may be modified at any time without prior notice. The website is hosted by Infomaniak Network SA, Rue Eugène-Marziano 25, 1227 Geneva, Switzerland.

Article 2 – Access to the Website

Hinatou.fr provides free access to promotional content and paid access to adult-only content and services, including videos, photographs, news, messaging, live broadcasts and private webcam sessions. Access is strictly prohibited to minors under the applicable laws of their country of residence. Users declare that they are of legal age and accept responsibility for their use of the website. Article 3 – Subscriptions and Payments

Users may cancel their subscription at any time, directly from their member account on Hinatou.fr or through the payment provider Epoch. Cancellation stops automatic renewal. Access to the services remains active until the end of the already paid subscription period. Each membership plan constitutes a separate offer. Upgrading to a higher plan requires a new subscription; no credit or adjustment is applied to the previous subscription. All sales are final once access to the content has been granted. By confirming payment, users expressly agree that access begins immediately and waive their right of withdrawal.

Article 4 – Content

All content published on Hinatou.fr, including texts, photographs, videos, audio recordings, graphics and logos, is the property of the Publisher or is used with the necessary authorizations. Any unauthorized reproduction, redistribution, publication or reuse is strictly prohibited and may result in legal action.

Article 5 – Private Messaging

The integrated messaging service is a private and confidential communication space available to members whose subscriptions include this feature. Messages are answered according to the availability of the Publisher. The messaging service does not constitute a sexual service and does not imply any obligation to provide immediate, continuous or prolonged responses. Article 18 – Live Broadcasts

Hinatou.fr may organize live audiovisual broadcasts accessible to registered users or subscribers according to their access rights. Live broadcasts are organized at the Publisher's discretion, according to availability and technical conditions. No fixed frequency, minimum number of broadcasts, specific schedule or minimum duration is guaranteed. Announced broadcasts may be postponed, interrupted, cancelled or modified. Access to a live broadcast depends on the user's subscription, account status and applicable age verification requirements. The Publisher retains full control over the content, organization, duration and termination of each broadcast. Users are strictly prohibited from recording, capturing, downloading, reproducing, retransmitting or distributing live broadcasts, whether in whole or in part, without prior written authorization.

Article 19 – Live Chat and Interactive Communication

Certain live broadcasts may include an interactive chat allowing authorized users to communicate with the Publisher or other participants. Participation must remain respectful and comply with applicable laws and these Terms. Harassment, threats, insults, discrimination, spam, repeated unwanted requests and illegal or inappropriate content are prohibited. These sessions may allow two-way audiovisual communication (cam-to-cam), during which both the Publisher and the participating user may activate their cameras and microphones. Users may request cancellation or rescheduling by contacting the Publisher. Any applicable refund or compensation rights remain subject to the agreed payment conditions and mandatory applicable law. All participants must be adults. Users are strictly prohibited from displaying minors, allowing minors to participate or exposing minors to the audiovisual communication. Users must ensure that any person appearing or speaking through their camera or microphone is an adult and has expressly consented to participation. Users must not display illegal content, engage in harassment, make threats or attempt to coerce another participant. The Publisher and the user remain free to activate or deactivate their cameras and microphones and to end their participation at any time. No participant is required to perform any particular act or comply with requests made by another participant.

Article 21 – Confidentiality and Prohibition of Recording

Live broadcasts, private webcam sessions, private messages and interactive communications are intended exclusively for their authorized recipients. Article 23 – Age Verification and Protection of Minors

Deleting an account does not automatically cancel an active subscription managed by a third-party payment provider. Users must cancel recurring payments through the relevant payment provider. Personal data associated with a deleted account are erased or anonymized in accordance with applicable regulations, except where retention is required for legal, accounting, security or dispute-resolution purposes. Article 26 – Content Catalogue and Updates

The catalogue of videos, photographs, articles and other content available on Hinatou.fr may evolve over time. The Publisher may add, update, reorganize, replace, archive or remove content for editorial, technical, legal or operational reasons. A subscription provides access to the content and services included in the selected membership during its validity period, but does not guarantee permanent availability of any particular video, photograph or publication. The number, frequency and nature of new publications may vary according to the Publisher's activity and availability. These provisions do not affect users' mandatory rights under applicable consumer protection laws.
